Terms of Use
Welcome to WhatPhone ("WhatPhone", "we", "our", or "the Service"). By accessing or using the WhatPhone website (https://whatphone.github.io/) and any related tools or features, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Service.
1. Acceptance of Terms
By using WhatPhone, you represent that you are at least 13 years of age (or the age of digital consent in your jurisdiction) and that you have the legal capacity to enter into these terms. If you are using the Service on behalf of an organization, you agree to these terms on behalf of that organization.
2. Description of Service
WhatPhone provides a web-based utility that detects and displays information about your device, including but not limited to: device model, operating system version, browser details, screen resolution, hardware capabilities (CPU, RAM), battery status, network type, and browser feature support. All detection is performed entirely within your browser using JavaScript APIs. No data is transmitted to our servers. The Service is provided "as-is" and is intended for informational and diagnostic purposes.
3. Use of the Service
You agree to use WhatPhone only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates applicable laws or regulations.
- Attempt to reverse engineer, decompile, or extract the source code of our JavaScript (except as permitted for debugging or personal education).
- Use automated scripts, bots, or crawlers to excessively access the Service beyond normal human usage.
- Use the Service to infringe upon the intellectual property rights of others.
- Misrepresent your device information or interfere with the proper functioning of the detection logic.
- Use WhatPhone as part of any illegal surveillance, stalking, or privacy-invasive activity.
4. Accuracy of Information
While WhatPhone strives to provide accurate device detection, we do not guarantee that the identified device model, specifications, or capabilities are 100% accurate or complete. Factors that may affect accuracy include:
- Privacy restrictions imposed by browsers (e.g., iOS limits model exposure).
- User Agent spoofing or modification by browser extensions.
- Unavailable APIs due to browser permissions or security policies.
- Virtualized or emulated environments.
The information displayed is provided for general informational purposes only and should not be relied upon for critical decision-making (e.g., medical, legal, financial). You assume full responsibility for any reliance on the information provided.
5. Intellectual Property
All content, design elements, graphics, code, and functionality of WhatPhone — including but not limited to the HTML, CSS, JavaScript, UI components, and device detection logic — are owned by WhatPhone or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of the Service without our prior written consent, except for your own personal, non-commercial use.
You are permitted to link to WhatPhone and share detection results (e.g., copying the JSON report) for personal or support purposes. However, you may not embed the detection tool into iframes or use it as part of a competing service without permission.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. You assume all risks associated with using the Service, including any potential impact on your device or data. Since all processing is local, WhatPhone cannot be held responsible for any pre-existing vulnerabilities in your browser or operating system.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WHATPHONE, ITS DEVELOPERS, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow the exclusion or limitation of liability, our liability shall be limited to the fullest extent permitted by law. Because the Service is provided free of charge, you agree that any remedy available to you shall be limited to discontinuing use of the Service.
8. Third-Party Links & Hosting
WhatPhone is hosted on GitHub Pages, a service provided by GitHub, Inc. Your use of GitHub Pages is subject to GitHub's Terms of Service and Privacy Policy. We are not responsible for the actions or policies of GitHub, nor for any data that GitHub may collect through standard server logs (e.g., IP addresses, request timestamps). For more information, please review GitHub's privacy practices.
The Service may contain links to external websites (e.g., GitHub repository). We do not endorse or assume responsibility for the content, privacy policies, or practices of any third-party sites.
9. Modifications to Terms
We reserve the right to update or modify these Terms of Use at any time without prior notice. The most current version will be posted at /terms with an updated "Last updated" date. Your continued use of WhatPhone after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
10. Termination
We may terminate or suspend your access to WhatPhone immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive (including disclaimers, limitation of liability, and governing law).
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action arising out of or relating to these Terms or your use of the Service shall be filed exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of such courts.
12. Severability & Waiver
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
13. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and WhatPhone regarding your use of the Service, superseding any prior agreements or understandings.
14. Contact Information
